Seller Disclosure Statement (HRS 508D)

Hawaii's required written seller disclosure for residential real property of one to four units, including leasehold property and residential condos or co-ops. A material fact is one expected to measurably affect value to a reasonable person. The seller signs within six months before to 10 days after acceptance and delivers it within 10 calendar days after acceptance. The buyer then has 15 calendar days after receipt to rescind in writing, with deposits returned immediately. Sales to co-owners or close family and foreclosures are exempt.

Exam tip
'Six back, ten forward, fifteen to walk.' Ten days is the seller's delivery deadline from acceptance; fifteen is the buyer's rescission window from receipt.
Example
An offer is accepted May 1 and the statement delivered May 8. The buyer's 15-day window closes May 23, so a May 20 rescission is timely.
