Iowa Seller Disclosure Statement (Chapter 558A)
Iowa Code chapter 558A requires a written disclosure for transfers of one-to-four-unit property, with or without a licensee, covering structure, systems, radon, lead, flood plain, and lead water service lines. It must be delivered before the seller makes or accepts a written offer. If delivered late, the buyer may revoke without liability within three days of personal delivery or five days of mail or electronic delivery. Electronic delivery requires a written acknowledgment; auto-replies do not count. Court, foreclosure, quitclaim, and family transfers are exempt.
- Exam tip
- 'Hand it: 3. Send it: 5.' Liability requires actual knowledge or failure to use ordinary care.
- Example
- A seller accepts an offer Monday and the disclosure is emailed Tuesday. The buyers reply 'received' Wednesday, starting a five-day revocation window.
