Mandatory E&O Insurance (Idaho)

Under Idaho Code 54-2013, every actively licensed Idaho licensee must carry errors and omissions insurance covering licensed activities, certified at licensing and renewal, through the Commission's group policy or an independent policy meeting the minimums. Individual minimums are $100,000 per occurrence and $300,000 annual aggregate, exclusive of defense costs, with a deductible no more than $3,500 and a 90-day extended reporting period. Failing to maintain coverage results in denial or inactivation of the license. Inactive licensees need coverage only when activating.

Exam tip
'100-300, 3,500, 3 days.' Automatic inactivation for lapsed E&O carries no right to a hearing.
Example
A licensee with an independent policy is asked for proof and fails to produce the certificate within 30 days, so the Commission may inactivate her license.
