Limited Agency and In-House Agency (Indiana)

A limited agent is an Indiana licensee who personally represents both seller and buyer, allowed only with written consent of all parties containing six statutory statements, signed at the start of the relationship. Without consent the limited agent may not disclose that a buyer will pay more, a seller will accept less, motivation, or terms giving an advantage. In-house agency is different: two licensees in the same company each represent their own client, the managing broker represents no one unless personally involved, and knowledge is not imputed.

Exam tip
'One face, two clients: limited. Two faces, one roof: in-house.' The office policy must specifically permit or reject limited agency.
Example
Two brokers at the same firm represent seller and buyer. That is in-house agency; if the buyer instead hired the listing broker herself, she would be a limited agent.
