Seller's Residential Real Estate Sales Disclosure (Indiana)
Indiana's required form under IC 32-21-5 for sales, exchanges, installment contracts, and lease-options of one-to-four-unit residential property. The owner completes, signs, and delivers it before accepting an offer, disclosing known conditions of the foundation, systems, roof, structure, water and sewer, plus items like meth contamination and flood plain location. An accepted offer is not enforceable against the buyer until both sign the form. If a defect is disclosed after acceptance, the buyer may cancel within two business days. It is not a warranty.
- Exam tip
- 'Form before yes; defect after yes = two days to go.' Never-inhabited new construction, foreclosure sales, and transfers to a spouse are exempt.
- Example
- A disclosure delivered May 3, after a May 1 acceptance, reveals a foundation crack. The buyer has two business days to rescind and recover the earnest money.
