Broker's Commission Lien (Kentucky)
Under KRS 376.075, a Kentucky broker may claim a lien on real property for an earned commission, but only under a written agreement. The lien statement must be filed within 6 months, and the broker has 12 months to enforce it. The lien is a license-law topic because it rewards brokers who put compensation agreements in writing.
- Exam tip
- The trap is an oral commission agreement: no written agreement, no broker's lien. Remember 'written, 6 months to file, 12 months to enforce.'
- Example
- A broker with a signed listing agreement is not paid the commission she earned; she files a lien within 6 months and sues to enforce it within 12 months.
