Agency Disclosure Pamphlet (Louisiana)

The LREC's required pamphlet explaining clients versus customers, designated agency and dual agency. Licensees must give the most recent Commission version to prospective sellers, lessors, buyers and lessees at the time of substantive contact: when discussing a person's specific financial qualifications, or motives and goals that could hurt their negotiating position. Delivery is documented by signature, electronic acknowledgment with date and time, or a written record of refusal, kept for five years. Signing creates no agency relationship.

Exam tip
The trigger is 'substantive contact', not first contact; answering questions about square footage or price is a ministerial act that does not yet require the pamphlet.
Example
An open-house visitor says they are pre-approved for $410,000 but don't want to exceed $390,000; the salesperson must stop and provide the pamphlet before going further.
