lead-based paint disclosure
Lead-based paint disclosure is a federal requirement for the sale or lease of most housing built before 1978. Sellers and landlords must disclose any known lead-based paint or hazards, provide available reports, give buyers or tenants the EPA pamphlet on lead hazards, and include a warning statement in the contract. Buyers must be offered a 10-day opportunity to conduct a lead inspection, which they may waive. Agents share responsibility for compliance.
- Exam tip
- Memorize the numbers: housing built before 1978, a 10-day inspection opportunity for buyers, and records kept for 3 years. The seller does not have to test or remove the paint.
- Example
- A 1965 house is listed for sale. The seller signs the lead disclosure form, the buyer receives the EPA pamphlet, and the buyer chooses to waive the 10-day inspection.
