agency

Facilitator (Massachusetts)

A Massachusetts licensee who helps one or more parties reach an agreement without representing anyone. Under 254 CMR 3.00(13)(e), written notice that no agency exists must be given at the first personal meeting about a specific property. A facilitator still must present property honestly and accurately and disclose known material defects, as every licensee in every relationship must.

Exam tip
A facilitator owes no fiduciary loyalty to either side, but the duty to disclose known material defects still applies.
Example
A licensee helps a FSBO seller and an unrepresented buyer complete a sale; at their first meeting about the house she gives written notice that she represents neither party.
