Mandatory Licensee-Consumer Relationship Disclosure

The Board-approved Massachusetts form that tells a buyer or seller what relationship the licensee has with them: seller's agent, buyer's agent or facilitator, and for agency roles whether it is designated or non-designated agency. It states 'THIS IS NOT A CONTRACT' and creates no obligation. The consumer keeps the original and the licensee keeps a copy for three years. If the consumer declines to sign, the licensee records the date given and the refusal and keeps that record for three years.

Exam tip
Signing the disclosure does not hire the licensee or obligate the consumer to pay; a refusal to sign is documented, not a reason to stop.
Example
A buyer at an open house declines to sign the form; the agent checks the refusal box, dates it and keeps the record for three years.
