Psychologically Impacted Property (c.93 §114)
Massachusetts law declares that the fact or suspicion that a property is psychologically impacted is not a material fact requiring disclosure. Covered facts are an occupant who has or was suspected of having HIV/AIDS or another disease highly unlikely to be transmitted through a dwelling; the property being the site of a felony, suicide or homicide; and an alleged parapsychological or supernatural phenomenon. No claim arises for failing to disclose these facts, but the statute does not permit a false statement.
- Exam tip
- Stigma: silence is OK. Physical defect: must disclose. An answer that lets the licensee deny a fact when asked is always wrong.
- Example
- A three-family was the site of a homicide eight years ago and its basement floods; the agent need not volunteer the homicide but must disclose the flooding.
