Intra-Company Agent (Maryland)
Under BOP §17-530.1, when one Maryland brokerage represents both seller and buyer, only the broker or a designated branch office manager may act as dual agent, with the written informed consent of all parties. The dual agent must assign one affiliated licensee as intra-company agent for the seller and a different one for the buyer. Each intra-company agent gives full services to its own client, including advice on price and negotiation, and may share confidential information only with the dual agent.
- Exam tip
- The broker is the dual agent; the salespeople are intra-company agents who can still advise on price. A dual agent cannot also be an intra-company agent in the same deal.
- Example
- A firm's listing salesperson and a buyer salesperson in the same firm become intra-company agents after both clients sign the Consent for Dual Agency, and the broker acts as dual agent.
