Maine Real Estate Commission

Maine's brokerage regulator, inside the Office of Professional and Occupational Regulation, administering the Real Estate Brokerage License Act (32 M.R.S. Chapter 114) and its numbered rule chapters, such as Chapter 400 (agency and designated broker duties) and 410 (minimum standards of practice). Under §13062 it has six members, four industry members with at least five years as Maine brokers or associate brokers and two public members, appointed by the Governor for three-year terms. Its Director handles day-to-day administration and may inspect trust account records.

Exam tip
The Director, not the Governor or Attorney General, inspects trust account records and brokerage files at the agency's place of business.
Example
The Director writes asking to inspect a firm's trust ledger at 10 a.m. Tuesday; the designated broker must make the records available at the place of business.

1. How many members sit on the Maine Real Estate Commission?

Answer & explanation

Answer: B. Section 13062 creates a six-member Commission: four industry members and two public members. Five is a tempting guess if you remember only the industry seats plus one public member.
