Seller's Property Disclosure Statement (Maine)

The disclosure required of Maine residential sellers under 33 M.R.S. §171 et seq. covering items such as the water supply (including PFAS test results), heating system, waste disposal system and other listed conditions, with flood history and access added in recent years. It must be delivered no later than when the purchaser makes an offer. If it arrives after the offer, the purchaser may terminate the contract or withdraw the offer within 72 hours of receipt without penalty, until settlement or occupancy. Fiduciary transfers such as estate sales are exempt.

Exam tip
The late-delivery remedy is 72 hours from receipt, and it ends at settlement or occupancy, whichever comes first.
Example
A buyer offers Monday at 2 p.m.; the seller delivers the disclosure Tuesday at 9 a.m.; the buyer can withdraw without penalty until Friday at 9 a.m.
