Spousal Joinder for Homestead (Minnesota)
Under Minn. Stat. §507.02, if the owner is married, no conveyance of the homestead is valid without both spouses' signatures, even if only one spouse is on title. A deed or mortgage of the homestead signed only by the titled spouse is not valid, with limited exceptions such as the purchase-money mortgage. For non-homestead property, a married owner may convey by separate deed, but the conveyance is subject to the other spouse's statutory rights.
- Exam tip
- 'Home needs both hands': two spouses, two signatures for the homestead, unless it is the mortgage that bought the house.
- Example
- A husband alone holds title to the family home; the listing broker makes sure his wife also signs the purchase agreement and deed.
