Administrative Hearing Commission (Missouri)

An independent Missouri state tribunal that holds the hearing in a real estate disciplinary case and decides whether cause for discipline exists. The Missouri Real Estate Commission investigates, decides whether to file a complaint, and, once the AHC finds cause, decides the actual discipline. This split between the fact-finding tribunal and the Commission that imposes sanctions is distinctive to Missouri.

Exam tip
The AHC finds whether cause exists; the Real Estate Commission chooses the penalty. Do not reverse the roles.
Example
After the AHC rules that a broker failed to account for escrow funds, MREC then holds its own disciplinary hearing to choose the sanction.
