Broker Disclosure Form (Missouri)
The Commission form (RSMo 339.770; 20 CSR 2250-8.097) that a licensee must give in a residential transaction to a seller, landlord, buyer or tenant who has not signed a written agreement for services. It is due at the earliest practicable opportunity during or after the first substantial contact, and under the rule upon obtaining personal or financial information or before signing a brokerage service agreement, whichever is first. Each party must later confirm the relationship in writing on or before that party's first signature on the real estate contract.
- Exam tip
- Two steps: the form at first substantial contact, then written confirmation of the relationship on or before the party's first signature on the contract.
- Example
- A seller shares that she must sell in 30 days because of a job transfer; before the conversation goes further, the licensee gives her the Broker Disclosure Form.
