Designated Agency (Missouri)
Under RSMo 339.820, a designated broker who signs a limited agency agreement may appoint in writing one or more affiliated licensees as the client's designated agents, to the exclusion of all other affiliated licensees in the firm. When one designated agent represents the seller and another in the same firm represents the buyer, the designated broker is not considered a dual agent or transaction broker solely because of the appointments. Only a licensee who personally works with both sides becomes a dual agent or transaction broker.
- Exam tip
- In-house sales with two different designated agents do not make the designated broker a dual agent.
- Example
- A firm appoints one agent for a seller and a different agent for an in-house buyer; neither agent nor the designated broker is a dual agent.
