Psychologically Impacted Real Property (Missouri)
Under RSMo 442.600, the fact that property is, or is near, psychologically impacted real property is not a material fact that must be disclosed. It covers property where an occupant is or was infected with HIV or diagnosed with AIDS (or another disease highly unlikely to spread through occupancy), or that was the site of a homicide, other felony or suicide. No cause of action may be brought against a broker for failing to disclose it, but the statute does not authorize lying in response to a direct question.
- Exam tip
- Missouri has no general mandatory seller disclosure form, but licensees must still disclose known adverse material facts; stigma is not one of them.
- Example
- A home was the site of a suicide two years ago; the listing agent need not volunteer it but must not answer falsely if a buyer asks directly.
