Non-Material Facts (Stigmatized Property, Mississippi)
Under Miss. Code Ann. §89-1-527, certain facts or suspicions are not material facts requiring disclosure, including that the property was the site of a natural death, suicide, homicide or felony crime, or any occurrence with no effect on its physical condition. The key exception is illegal drug activity that affects the property's physical condition, environment or improvements, such as meth lab contamination.
- Exam tip
- Stigma is not material, but drug activity that physically contaminated the property is. A false answer to a direct question can still be fraud.
- Example
- A buyer learns after closing that a suicide occurred in the house last year; it is not grounds for rescission, but contamination from a former meth lab would have to be disclosed.
