Property Condition Disclosure Statement (PCDS)
The seller disclosure required by Mississippi's Real Estate Transfer Disclosure Requirements (Miss. Code Ann. §§89-1-501 to 89-1-527) for transfers of one to four dwelling units made by or with the aid of a licensee. If the PCDS or a material amendment arrives after the buyer executes an offer, the buyer may terminate by written notice within 3 days after hand delivery or 5 days after mailing. Since the March 14, 2023 amendments, licensees have no duty or liability regarding the PCDS; it is the seller's document.
- Exam tip
- A true FSBO with no licensee is outside the statute; and licensees cannot be disciplined over PCDS content or delivery, though they can still be disciplined for their own misrepresentations.
- Example
- A seller mails the PCDS on June 3 after accepting an offer; the buyer may terminate by written notice through June 8.
