In-House Designate (Montana)
When one Montana brokerage holds both sides of a transaction, the broker may designate one licensee as the exclusive agent of the seller and another as the exclusive agent of the buyer for that transaction. Each designate is treated as acting only for that party, and by definition an in-house designate is not a dual agent. By contrast, one licensee representing both sides is a dual agent and needs the signed, written consent of both buyer and seller.
- Exam tip
- Same brokerage with two designated licensees means in-house designates, not dual agency; one licensee for both sides means dual agency with written consent.
- Example
- A firm's listing salesperson and another salesperson with a buyer client in the same firm are designated for their respective clients, so neither is a dual agent.
