Initial and Subsequent Relationship Disclosure (Montana)
MCA 37-51-314 requires two written forms. A seller agent gives the initial disclosure to the seller when the listing agreement is signed; a buyer agent gives it when the buyer broker agreement is signed; a statutory broker gives it when first trying to locate property for the buyer. The initial disclosure describes the licensee's duties, the dual agency statement, the definition of adverse material fact, the relationship type, and signatures and date. The shorter subsequent disclosure goes to the other side when negotiations begin.
- Exam tip
- Montana has no 'first contact' trigger; know which event triggers each role's initial disclosure.
- Example
- A seller agent gives the seller the initial disclosure at listing, then gives the buyer's agent a subsequent disclosure, included in the buy-sell agreement, when negotiations start.
