NAR settlement

The NAR settlement refers to the 2024 agreement resolving class-action lawsuits over real estate commissions. Effective August 2024, offers of buyer broker compensation may no longer be published on MLSs that follow NAR rules, and MLS participants working with buyers must have a written agreement with the buyer before touring a home. Commissions remain fully negotiable. State laws may add further requirements.

Exam tip
Know two key changes: no compensation offers on the MLS, and a written buyer agreement before touring. Commissions have always been negotiable, and the settlement did not set rates.
Example
Before showing a buyer three homes, the agent has the buyer sign a written agreement stating the agent's compensation of 2.5%.

1. After the 2024 NAR settlement practice changes, a buyer wants to tour homes with an MLS participant. What is generally required first?

Answer & explanation

Answer: D. The settlement practice changes require MLS participants working with buyers to sign a written agreement before touring, with an objectively ascertainable compensation amount. Pre-approval and seller-paid commission arrangements do not satisfy the requirement.
