Residential Property and Owners' Association Disclosure Statement (RPOADS)

The Commission form that Chapter 47E requires owners of one-to-four-unit residential property to give buyers, whether or not a broker is involved. It must be delivered no later than when the buyer makes an offer. If late, the buyer may cancel by written notice without penalty until the earliest of three calendar days after receipt or settlement or occupancy. Owners may answer Yes, No or No Representation, but No Representation never relieves a broker of the duty to disclose material facts.

Exam tip
The cancellation right is about late delivery only; a buyer who dislikes the answers relies on the due diligence period instead.
Example
A seller checks 'No Representation' on the roof question, but the listing broker knows the roof leaks; the broker must still disclose it.
