Appointed Agent and Designated Broker (North Dakota)
Under NDCC 43-23-06.1, the designated broker is the licensee designated to act for the firm, and an appointed agent is a licensee the designated broker appoints to act solely for a particular client. Agency requires a written agency agreement; without one, a person is a customer. Dual agency exists only when both parties have written agency agreements with the same firm, and subagency is not a written agency agreement. Recognized relationships are seller's, buyer's, dual, appointed agency and subagency.
- Exam tip
- No written agreement, no client. Customers receive honesty, good faith and disclosure of known material adverse facts, but not loyalty or confidentiality.
- Example
- A buyer signs a written buyer's broker agreement with a firm, and the designated broker appoints one salesperson to act solely for that buyer.
