Limited Agency and Buyer's Limited Agent Default (Nebraska)
Since 1994 Nebraska has codified brokerage relationships as limited agency (76-2401, 76-2416): a licensee owes the duties listed in the statute, not the full set of common-law fiduciary duties, unless a written agreement expands them. A licensee may act as a single agent, subagent, dual agent with written informed consent, or under an expanded-duty agreement. A licensee working with a buyer or tenant is presumed to be the buyer's or tenant's limited agent unless the designated broker has a written seller agency, subagency, dual agency or expanded-duty agreement in place.
- Exam tip
- Nebraska's default runs toward the buyer: without other written arrangements, the licensee working with a buyer is presumed to be the buyer's limited agent.
- Example
- A licensee from a firm with no listing on a home shows it to a buyer; absent other written agreements, the licensee is presumed to be the buyer's limited agent.
