Mandatory Written Buyer Agreement (Nebraska)
Since July 1, 2025 (LB 187), a Nebraska broker must have a written buyer agency agreement before performing agency acts for a buyer of one-to-four-unit residential property. NREC guidance says those acts include showing a property, negotiating, or claiming to be the buyer's agent. The agreement must include the 76-2418 duties, compensation, a specific expiration date and whether subagency may be offered.
- Exam tip
- For 1-4 unit residential buyers, a written agreement is now mandatory; an answer calling it optional is wrong.
- Example
- Before taking a buyer to see three houses on Saturday, the agent has the buyer sign a buyer agency agreement stating compensation and an expiration date.
