Seller Property Condition Disclosure Statement (Nebraska)
Under Neb. Rev. Stat. 76-2,120, a seller of residential property with one to four dwelling units must give the buyer a written, signed disclosure statement on the Commission's form (Title 302 NAC) no later than when the purchase agreement becomes binding on the buyer, and the buyer acknowledges receipt in writing. It covers appliances, systems, structural defects, environmental hazards, title matters and more. It is not a warranty, not a substitute for inspection and not part of the contract, but the buyer may rely on it.
- Exam tip
- The statement reflects the seller's knowledge, not the agent's; a seller may honestly answer 'don't know'.
- Example
- A seller completes the form, then discovers a roof leak before the purchase agreement becomes binding; she must update the statement.
