Seller's Real Property Disclosure Form (SRPD)

The seller's own statement of a specific property's condition, required by NRS 113.130 and completed by the seller, not the agent. It must reach the buyer at least 10 days before conveyance. If no form is delivered, the buyer may rescind any time before conveyance without penalty. If a defect is disclosed before closing and repair costs are not capped, the buyer may rescind by notarized written notice within 4 working days. A seller who knowingly conveys without disclosing a defect owes treble the repair cost plus fees.

Exam tip
Separate the educational Residential Disclosure Guide (distributed by licensees) from the SRPD (the seller's statement). Know 10 days, 4 working days and treble damages.
Example
A seller hid a known roof leak costing $14,000 to fix; the buyer may recover 3 x $14,000 = $42,000 plus costs and attorney's fees.
