Waivable Duty to Present All Offers (Nevada)

Among the duties a Nevada licensee owes a client under NRS 645.254 is presenting all offers made to or by the client as soon as practicable. That is the only statutory client duty a client may waive, and only by signing a waiver on the Division's form. Other client duties, such as reasonable skill and care, seeking the client's terms, and keeping confidential information private for one year after the brokerage agreement ends, cannot be waived.

Exam tip
'Only offers go off': presenting offers is the one duty that can be switched off, and only with a signed Division waiver form.
Example
A seller under contract signs the Division's waiver so her agent need not present backup offers; without that signed form, the agent must present every offer.
