New York Department of State (DOS)

The agency, through its Division of Licensing Services, that issues New York real estate licenses, investigates complaints and disciplines licensees under Article 12-A of the Real Property Law (RPL §440 and following) and the rules in 19 NYCRR Part 175. Separately, RPL §442-i creates the State Real Estate Board, a 15-member advisory and policy body that includes the Secretary of State and the Superintendent of Financial Services and advises DOS on rules, education and policy.

Exam tip
The Department of State licenses and disciplines; the State Real Estate Board only advises. New York has no 'real estate commission'.
Example
A consumer complains that a salesperson posted a discriminatory ad; DOS investigates and treats it as licensee misconduct.
