Agency Disclosure Form (RPL §443)
New York's state-prescribed form explaining seller's agents, buyer's agents, broker's agents, dual agents and designated sales agents, with separate versions for sales and for rentals. It applies to residential property with a one-to-four family dwelling, condo unit or co-op apartment, not vacant land or commercial property. A listing agent gives it to the seller before the listing agreement; an agent gives it to the other side at first substantive contact. If a consumer refuses to sign, the licensee completes a sworn declaration of refusal and keeps it three years.
- Exam tip
- Condos and co-ops are covered by §443 even though they are excluded from the Property Condition Disclosure Act. Signing the acknowledgment creates no contract.
- Example
- At an open house a couple starts asking whether the seller would take less; the listing agent gives them the §443 form and explains she represents the seller.
