Housing and Anti-Discrimination Disclosure Form (New York)

A Department of State form required since 2018 (19 NYCRR §175.28) that licensees must give at first substantive contact to every prospective buyer, tenant, seller and landlord, in sales and rentals. It explains the protected classes under federal and New York law, the duties of owners and licensees, and where to file complaints: the NYS Division of Human Rights, HUD and, in New York City, the City Commission on Human Rights. Brokers must also post the DOS Fair Housing Notice in the office window, on websites and at open houses.

Exam tip
'Two forms at hello': the §443 agency form and the fair housing form both come at first substantive contact, and the fair housing form goes to all four parties.
Example
A rental agent meets a prospective tenant to discuss budget and neighborhoods and hands over both the agency disclosure and the Housing and Anti-Discrimination Disclosure Form.
