Psychologically Impacted Property (Oklahoma)
In Oklahoma, certain facts are not material facts requiring disclosure: that an occupant is, was, or was suspected of being infected with HIV, AIDS, or a disease unlikely to spread through occupancy, or that the property was or was suspected of being the site of a suicide, homicide, or other felony. However, if a buyer or tenant making a bona fide offer states in writing that such information matters, the licensee must ask the owner and may answer only with the owner's consent, or report that the owner declined.
- Exam tip
- 'Ask in writing, ask the owner, answer only with consent.' No cause of action arises for simply not disclosing these facts.
- Example
- A buyer's written offer asks whether anyone died violently in the house; the associate asks the owner, who declines, and the associate tells the buyer the owner declined to answer.
