Residential Property Condition Disclosure Statement (Oklahoma)
Under Oklahoma's Residential Property Condition Disclosure Act, a seller of property with one or two dwelling units who is represented by a licensee, or who receives a written request from a buyer, must deliver the OREC disclosure statement. It reports defects within the seller's actual knowledge, such as flood zone, structure, wood-destroying organisms, fire or tornado damage, and prior methamphetamine manufacturing. It must be dated no more than 180 days before the buyer receives it and delivered before the seller accepts an offer. It is not a warranty.
- Exam tip
- Timing is before the seller accepts an offer, not before closing. Buyer suits are limited to actual damages and must be filed within two years after the transfer, not after discovery.
- Example
- A seller who lived in her home and knows the roof leaked must use the disclosure statement and give it to the buyer before accepting the offer.
