HB 4058 Buyer Representation and Listing Rules (Oregon)

Oregon House Bill 4058, effective January 1, 2025, wrote post-NAR-settlement practices into statute. A licensee representing a buyer of residential land or one to four units must have a written buyer representation agreement signed before or as soon as reasonably practicable after starting to help the buyer. Residential listings must be written before marketing. Buyer agreements, listings, and future listing agreements are capped at 24 months including renewals. It also requires wholesalers to register and give disclosures.

Exam tip
'4058 = 24 and 3': the 24-month cap and three documents for disclosed limited agency. Commercial and five-plus-unit property is exempt from the listing agreement requirement.
Example
A broker proposes a 30-month exclusive buyer agreement with automatic renewals; it violates the 24-month cap, so he shortens it to six months.
