Seller's Property Disclosure Statement (Oregon)
Under ORS 105.465, an Oregon seller of property with one to four dwelling units (and certain condos, timeshares, and land-owned manufactured homes) must deliver a statutory seller's property disclosure statement to each buyer who makes a written offer. The buyer may revoke the offer by a separate signed written statement within five business days after delivery and receive deposits back immediately. If the statement is never delivered, the right lasts until closing. Lender REO sales, court-appointed fiduciary sales, and government sales are exempt.
- Exam tip
- 'Five days to flee, closing locks the door.' The five business days run from delivery of the statement, not from acceptance.
- Example
- A seller delivers the statement Monday, March 2 after accepting an offer Friday; the buyer has through Monday, March 9 to revoke in writing.
