Consumer Notice (Pennsylvania)
The Consumer Notice is Pennsylvania's mandatory Commission disclosure form explaining possible business relationships, duties all licensees owe, that fees are negotiable, the Recovery Fund, and the zoning disclosure. It must be given at the initial interview, meaning the first contact with a consumer. If first contact is by phone or email, the licensee gives an oral disclosure, including that information shared is not confidential, then delivers the written notice by the earlier of the first in-person meeting or first showing. It states that it is not a contract.
- Exam tip
- 'First Contact, Not Contract.' The tempting wrong answer is 'before the agreement of sale is signed,' which is the seller property disclosure deadline. Commercial deals are exempt unless a party is an individual.
- Example
- A buyer phones a licensee Tuesday about a listing; she gives the oral disclosure and must hand him the written notice no later than their Saturday showing.
