State Real Estate Commission (Pennsylvania)

The State Real Estate Commission administers Pennsylvania's Real Estate Licensing and Registration Act (RELRA) from within the Department of State's Bureau of Professional and Occupational Affairs; its rules are in 49 Pa. Code Chapter 35. Its 11 members include five brokers with 10 years' experience, three public members, one cemetery broker, the BPOA Commissioner, and the Consumer Protection director, serving five-year terms. It licenses, approves education, adopts the Consumer Notice, disciplines, and runs the Recovery Fund, but does not set commissions or award damages.

Exam tip
'5-3-1 plus 2 officials = 11.' Discrimination complaints go to the Pennsylvania Human Relations Commission or HUD, not to this Commission, though it can still discipline the licensee.
Example
A seller complains her negotiated 5% commission was too high; the Commission cannot order a refund because fees are negotiable.
