Rhode Island Homestead Exemption

Rhode Island's homestead estate protects up to $500,000 of an owner's interest in a principal residence from most unsecured creditors. It arises automatically by operation of law, with no recorded declaration needed, and covers owners and certain possessors such as life tenants and trust beneficiaries who occupy or intend to occupy the home. It does not protect against mortgages and voluntary liens, mechanics' liens, tax and utility district liens, debts incurred before the homestead or to buy the home, or family court support orders.

Exam tip
Key answers: $500,000, automatic, principal residence, and the exceptions, especially mortgages, taxes, support orders, prior debts, and mechanics' liens.
Example
An owner with $400,000 of equity is protected from a forced sale on a later $40,000 contract judgment, but not from a contractor's mechanics' lien.
