Real Estate Sales Disclosure Act (Rhode Island)

Rhode Island's Real Estate Sales Disclosure Act requires the seller to give the buyer a written disclosure of all deficient conditions the seller actually knows, before the parties sign any agreement. Agents may not present the buyer's offer until the buyer has received it and signed a receipt. Commission-approved forms cover items such as radon, underground tanks, flood plain, wetlands, pre-1978 lead paint, and cesspools. Failure does not void the contract or cloud title, but carries a civil penalty up to $1,000 per violation.

Exam tip
Timing is before any agreement and before the offer is presented; the consequence is a penalty of up to $1,000 while the contract stays valid. Builder first sales and executor sales are exempt.
Example
Buyers want to offer Saturday but the seller has not finished the form; the listing licensee cannot present the offer until the buyers receive it and sign a receipt.
