agency
Transaction Facilitator (Rhode Island)
Under R.I. Gen. Laws chapter 5-20.6, which overrides common-law agency for residential deals (vacant land for one or two homes, or up to four units), every licensee is presumed to be a transaction facilitator unless a party gives informed written consent on the mandatory relationship disclosure to a designated client representative. A facilitator assists without representing anyone and owes only ministerial duties: showing property, preparing and conveying offers, honesty, reasonable skill and care, and accounting for funds. No agency may be created by implication.
- Exam tip
- If nothing has been signed, the relationship is transaction facilitator. 'Implied agency' and 'seller subagency' are wrong answers in Rhode Island.
- Example
- An open-house visitor declines representation; the salesperson can show the home and write up an offer but cannot advise on price strategy.
