Disclosure of Real Estate Brokerage Relationships (South Carolina)

South Carolina licensees who have substantive contact with a potential buyer or seller must, at the first practical opportunity, explain the firm's brokerage relationships, including customer versus client services, and provide the Commission-prescribed Disclosure of Real Estate Brokerage Relationships. Agency agreements must acknowledge receipt, and every sales contract must state whether each party received customer or client services. The disclosure is not required for rentals and leases or for mere solicitations of business. Failing to disclose whom the licensee represents is grounds for discipline.

Exam tip
Know the trigger (substantive contact), timing (first practical opportunity), and exceptions (rentals and leases, solicitations).
Example
A stranger calls and soon discusses why she must sell; the associate emails the disclosure for electronic acknowledgment.
