Appointed Agency (South Dakota)
In South Dakota, a responsible broker may appoint in writing one or more affiliated licensees to represent a client to the exclusion of all other firm licensees. Knowledge is not imputed among the client, brokerage, and appointed agent, so two appointed agents can represent opposite sides without becoming limited agents. If appointed agents are on the same team, all team members are appointed and representing both sides becomes limited agency, which requires all parties' written consent.
- Exam tip
- Who consents to what: limited agency needs all parties in writing; subagency needs the client in writing; appointed agency needs a written appointment disclosed before the agreement.
- Example
- A responsible broker appoints Jo to a seller and Sam to a buyer who offers on Jo's listing; neither is a limited agent unless Jo and Sam are on the same team.
