Property Condition Disclosure Statement (South Dakota)

South Dakota sellers of residential property with not more than four units in one structure must give the buyer a completed statutory disclosure statement before the buyer makes a written offer, and amend it if a material fact changes before closing or possession. The form covers title, structure, systems, hazards such as radon, lead, mold, and methamphetamine, and whether a homicide or suicide occurred. If the buyer receives it after making an offer, the buyer may terminate in writing within 3 days of in-person delivery or 6 days after mailing.

Exam tip
'Hand it: 3. Mail it: 6.' Timing is before a written offer. 'As is' language does not create an exemption.
Example
A buyer's agent hands the buyer a printed disclosure the evening after the offer was signed; the buyer has 3 days to terminate in writing.
