special use permit
Permission from a local zoning authority to use property in a way that is allowed in the zoning district only after review and approval, often with conditions. Also called a conditional use permit, it covers uses that benefit the community but need oversight, such as churches, schools, or hospitals in residential areas. It differs from a variance, which grants relief from a hardship.
- Exam tip
- A special use permit allows a use the ordinance already anticipates with approval; a variance is a deviation granted because strict rules cause hardship. Names and procedures vary by locality.
- Example
- A congregation wants to build a church in a residential zone; the town approves a special use permit requiring extra parking and limited evening hours.
