Facilitator (Tennessee)

In Tennessee, statutory duties replace common-law fiduciary duties, and a licensee is a facilitator, not an agent or advocate of any party, until a specific written agency agreement is signed. Agency or subagency cannot be assumed, implied, or created without a written bilateral agreement, though signing an exclusive listing establishes seller agency. A facilitator assists one or more parties and may advise them; 'transaction broker' is a synonym. Licensees must disclose their status verbally before providing services and in writing before an offer is prepared or a listing signed.

Exam tip
'No paper, no agent.' Answers saying agency arises by conduct, orally, or by accepting a commission are wrong in Tennessee.
Example
A licensee shows a buyer three FSBO homes without signing any agreement with anyone; she is a facilitator to everyone.
