Designated Agent (Tennessee)
A Tennessee designated agent is a licensee chosen by the managing broker to represent a client to the exclusion of all other licensees in the firm. When each designated agent represents only one party, the managing broker is not a dual agent and there is no imputation of knowledge among clients, the managing broker, and designated agents. Only the principal broker, not a team, may appoint designated agents. Acting as agent for more than one party without the knowledge and written consent of all parties is a violation.
- Exam tip
- Designated agency means no imputed knowledge and the managing broker is not a dual agent. Dual agency requires written consent of all parties.
- Example
- Aisha is designated for a seller and Ben for a buyer at the same firm; Aisha's knowledge of the seller's bottom line is not imputed to Ben.
