Tennessee Real Estate Commission (TREC)
The Tennessee Real Estate Commission enforces the Tennessee Real Estate Broker License Act of 1973 (T.C.A. Title 62, Chapter 13) through Rule Chapter 1260. It has nine governor-appointed members: seven licensees with five years of Tennessee experience and two consumer members, serving five-year terms, with three from each grand division. TREC licenses, approves education, investigates, disciplines, and manages the Education and Recovery Account. It cannot set commissions, does not referee commission or draw disputes between licensees, and does not award damages to consumers.
- Exam tip
- '9 by the Governor, 7 + 2, 5 and 5, 3-3-3.' A 'not within TREC's authority' question usually points to setting commissions, ordering a disputed fee paid, or awarding damages.
- Example
- An affiliate broker and her former firm both ask TREC to resolve a $2,400 draw dispute; TREC declines because it is a private contract matter.
